How long do I have to have to file a lawsuit?
The laws of each state set the amount of time available to file a lawsuit for mesothelioma. If you do not file your case within that time frame, you maybe be barred by the statute of limitations from filing a claim. Statutes of limitations vary from state to state, with some states allowing only one year to file a claim and others allowing three or even more years. The majority of states have a two year statute of limitations.
Can I file a lawsuit on behalf of my husband who recently passed away from an asbestos-related disease?
In most states, the answer to this question is yes. Provisions allow a spouse or other family member to file a wrongful death lawsuit on behalf of a loved one even if they had not filed a lawsuit while they were still alive. As with any lawsuit there is a set amount of time in which a wrongful death case must be filed. If the suit is not filed by this time the plaintiff may be barred from filing a lawsuit. If you plan on pursuing a lawsuit you should enlist the services of a mesothelioma attorney as soon as possible. In some states the compensation available in a wrongful death case may not be the same as it would have been if the victim had filed suit while still alive.
How will I afford to pay an attorney?

The only known cause of mesothelioma is exposure to asbestos. The vast majority of people were exposed to asbestos through their occupation. Since symptoms may not appear for more than 30 years after the initial exposure, it is not uncommon for a mesothelioma victim to have some trouble determining how they may have been exposed to the hazardous material. A consultation with an experienced attorney and a careful examination of your work and family history may shed some light on possible ways that you may have been exposed to asbestos.
